“Negligence is the failure to use reasonable care. Reasonable care is that degree of care which a reasonably careful person would use under like circumstances. Negligence may consist either in doing something that a reasonably careful person would not do under like circumstances or in failing to do something that a reasonably careful person would do under like circumstances.”

Products Liability

Injuries that are caused by a defective product could result in a claim for damages. The standard jury instructions that have been approved by the Supreme Court of Florida state that a product is defective:

  • if it does not conform to representations of fact made by the defendant, orally or in writing, in connection with the sale, on which the plaintiff relied in the purchase and/or use of the product;
  • if it is not reasonably fit for the uses intended or reasonably foreseeable by the defendant;
  • if it is not reasonably fit for the specific purpose for which the defendant knowingly sold the product and for which the purchaser bought the product in reliance on the judgment of the defendant;
  • if it is in a condition unreasonably dangerous to the user and the product is expected to and does reach the user without substantial change affecting that condition;
  • if by reason of its design, the product is in a condition unreasonably dangerous to the user and the product is expected to and does reach the user without substantial change affecting that condition.

A product is unreasonably dangerous because of its design if the product fails to perform as safely as an ordinary consumer would expect when used as intended or in a manner reasonably foreseeable by the manufacturer or the risk of danger in the design outweighs the benefits.

Will Contest

There are three ways to contest a will:

  • if the will is not properly signed by the person making the will and the witnesses;
  • if the person making the will is not mentally competent at the time the will is signed;
  • if somebody exercises undue influence over the person making the will.

A presumption of undue influence arises in cases where the person who benefits from the will has a confidential relationship with the person making the will and is active in procuring the will.

Undue influence can also occur in procuring other gifts such as deeds, bank accounts, or personal property.
